I don’t need a will!
No! You don’t … but you cannot rely on the laws of intestacy to:
• appoint someone (not of your choosing) to deal with your estate,
• protect a partner if you’re unmarried or not in a civil partnership,
• keep your estate out of the hands of distant relatives, or
• look after your wishes.
Wills are for old people!
A will is to protect those you leave behind, not a death wish! And you can change your will later if you want to.
Can it be cancelled?
You can revoke your will at any time. Otherwise your divorce, marriage or civil partnership will revoke some parts or all of the will.
Frequently Asked Questions
To be valid the testator (the person making the will) must be:
• over 18,
• acting voluntarily and without pressure from another person, and
• of sound mind.
The will must be:
• In writing,
• signed by the testator in the presence of two witnesses, and
• signed by those witnesses in the presence of the testator.
You must sign your will in the presence of two competent witnesses who should be aged over 18 years. A witness MUST know they are signing to witness your signature on a will but do not need to read the will or know its contents.
Your witnesses should not be:
• Anyone mentioned in your Will, including the executor, or
• Husband/Wife/Partner of anyone mentioned in your Will.
You and both your two witnesses must remain present at the same time, in sight of each other and the will, until the following procedure has been completed -
1 Fill in the date in words (eg "first" day of "January") where the blanks are left for the day and month at the end of the Will. Fill in the Year in figures.
2 You should sign your name with your usual signature (the same signature you use for cheques, etc) at the end of the Will next to the word "Signature".
3 Each witness should then sign his or her name where indicated and complete details of their full names, addresses and occupations where provided.
If you make a mistake, simply reprint the will and start again. All additions and signatures should be made in ink or pen and the same pen should be used by you and your witnesses.
Do not fix anything to a Will with a paper clip, pin or staple otherwise marks on a Will can give rise to questions as to whether other sheets of paper were attached that formed part of the Will when it was signed.
